			<content:encoded><![CDATA[<p></p><p>At the end of September 2006 the U. S.  Senate introduced &#8220;The Unlawful Internet Gambling Enforcement Act  2006&#8243;.  It wasn&#8217;t so much introduced as pushed through at the back end of the &#8220;Safe Port Act&#8221;, to which some commentators have taken exception.  This has caused a flurry of anxiety and (some would say) hysteria among players, website owners and online gambling affiliates alike.  But what does the new law actually mean? This article has a look at the facts behind the new legislation.<br />
The first clue is in the wording of the Act itself; it is an enforcement Act.  In other words it enforces previous and existing law where legality of gaming has already been established as a matter of precedent, and also the legality and illegality of different types of gaming already existing.<br />
I could do much worse than directly quoting the wise words from Cardplayers legal counsel.  He writes that the new bill<br />
&#8220;attempts to make it more difficult to get money into a site by forbidding US financial Institutions from funding the type of online gambling that the law has previously made illegal.  The new bill does not make online gaming illegal where it was not illegal before ?The bill merely speaks to the mechanism by which an online account is funded. &#8221;<br />
In other words the Act attempts to hinder Internet gambling sites by starving them of funds, by ordering the banks not to allow players to use their credit cards to play at those sites.<br />
There is nothing about the activity itself being illegal (where it was not illegal before).  And clearly, if the gambling sites in question are offshore, then by definition they are not subject to US legislation anyway.  So the only way to get at these offshore sites is through the banks and the credit card companies.<br />
The article I quote from goes on to cite the significance of the 1961 Wire Act, which was construed to have made sports betting illegal, but not games such as poker, on the grounds that the law was never enforced with regards to poker in the ten years that Internet gambling has existed.  Instead, the 33 cases which were brought under the Wire Act were pursued by &#8220;deadbeat gamblers&#8221; who simply did not want to pay their gambling debts.  The judge on that particular occasion, Stanwood R.  Duvall Jr,  threw out all 33 suits, so ruling that online poker was not within the reach of the Wire Act&#8217;s prohibition.<br />
Now while the lawyers are busying themselves on working out the construction of what the new law actually means, it seems that players can make a few simple choices in order to protect themselves from what might be construed:<br />
1.  Open an account at an offshore Internet casino website;<br />
2.  Ensure the site is registered with a non-US company;<br />
3.  Ensure the site is hosted by a non-US company.<br />
The vast majority of offshore Internet gambling sites still operate in US dollars, and they increasingly offer multiple currency choices.  You can select which currency you wish to use before you play.  Even so, it may be worthwhile remembering that, at the time of writing, there are approximately $1. 87 to the Pound Sterling, and $1. 26 to the Euro.<br />
If the law goes further it may well be necessary to apply for a credit card issued by a non-US bank.  But this is still something that is subject to speculation.  We will have to see how the new law pans out in practice.  In particular we will have to await the matter of how the law is construed and how precedent impacts upon it. </p>

During Barack Obama&#8217;s campaign for the presidency, his major focus was on three major domestic issues: health care, education and tax cuts for the middle class.  When asked how these issues would be financed, Obama stated that he would scrutinize the national budget and seize funding for any programs or initiatives that were deemed inefficient or unworkable and suggested he would find new source of revenues that were more realistic.  Although the U. S.  national budget is a massive and complex structure that has been seriously used and abused for the past eight years, and there are no simple overnight or easy fix solutions to repair the current damage done, here is one of many areas of internal revenue generation President-Elect Obama can look into. . .  The regulation of Online Gambling.  ? It is not commonly known, but the fact is that online gambling has actually generated over four billion dollars internationally in the past two years alone.  Bare in mind that this came with limited U. S.  participation since the implementation of UIGEA (otherwise known as The Unlawful Internet Gambling Enforcement Act).  And it is forecasted that the online gaming industry will top fifteen billion dollars by 2012 with or without the participation of the United States.  A Price Waterhouse Coopers (PWC) study revealed that the United States has the potential to collect at least $8. 7 billion and up to $17. 6 billion in the next 10 years if it would tax and regulate online gambling, including poker.  And those figures don?t include potential sports wagers.  The $8. 7 billion figure did not take into account the 10 states that currently have laws on their books that specifically prohibit online gambling, even though they allow some forms of gambling (Illinois, Indiana, Louisiana, Michigan, Nevada, New Jersey, New York, Oregon, South Dakota, and Washington).  If all the states would tax and regulate online gambling, $33. 9 billion in taxes would be generated in the next 10 years, according to the PWC study.  ? As a matter of domestic issue, there are still many other aspects of online gambling regulation that would need to be addressed such as monitoring for underage activity, policing black market or &#8220;rogue&#8221; casinos and support for addiction to name a few.  But just as we have done in the past with the prohibition of alcohol (which ironically shares many similarities to the prohibition of online gambling including a national financial crisis at the time) We the people of America wanted the choice of whether or not to drink, the free market suggested a potentially lucrative business for both domestic and imported product and our government saw a huge alcohol tax revenue that unarguably gave new life to an obviously failing economy.  ? Although there are so many other important agendas our new president will face such as the current situation in the middle east, international relations will be vital for Obama.  He must show the world leaders that he is not conducting &#8220;business as usual&#8221; and will fight to correct the international financial blunders of the Bush administration.  For instance; The United States (USA) and the European Union (EU) are currently battling over the Unlawful Internet Gambling Enforcement Act (UIGEA) and possible violations of the World Trade Organization (WTO) The EU is accusing the US of violating terms established by the WTO regarding online gambling companies operating within Europe.  This is a perfect opportunity for Obama and his administration to bring a &#8220;new deal to the table&#8221; (no pun intended).  This could potentially accomplish two goals; create a new source of revenue for our failing economy and repair a severed relation with the World Trade Organization.  ? With the current administration ready to implement the final regulations for the UIGEA just two months before being leaving the White House, this is an issue the new administration should address as soon as possible.  The potential long term damage this could cause on the U. S.  online gambling market would be devastating.  However, with the Unlawful Internet Gambling Enforcement Act abolished and a new sensible regulation written and implemented (I nominate Barney Frank for this job) we could create our own domestic gaming institutions and offer them on an international market.  We already have tax paying gambling operations here in the United States such as Caesars Palace, MGM Mirage, Harrah&#8217;s and more.  Perhaps they would like to expand the gaming aspect of their business to an international community.  This alone would create huge amounts of additional taxes these businesses already pay.  ? The bottom line is this; UIGEA was a bad idea from the beginning and it needs to be revoked.  The Obama administration needs to carefully look at online gambling and its potential as a major generator for future tax revenue.  It has been done before with alcohol prohibition and it can be done with gaming prohibition.  ? </p>

<p>Gambling is a legitimized activity in many states in the USA.  Many state and federal laws mandate statutes that govern the activity of gambling in the United States of America.   The US Gambling Laws are further divided into three sections ? State Laws, Federal Laws and Charitable Laws. &#13;</p>
<p>State Laws ? Most of the states in the United States of America have legalized gambling.   These gambling laws are applicable to any form of gambling which includes but is not limited to lotteries, casino gambling etc.   For example, the state law of Alabama lays down the rule that any person who has lost some money during gambling can claim the money back in six months from the date of the gambling. The Unlawful Internet Gambling Enforcement Act of 2006 mostly bans gambling operators in accepting funds from bettors through the internet. <p>Charitable Laws ? Majority of states in the United States of America have enforced laws that exempt some gambling activities from the gamut of the state and federal gambling laws. In October 2006 the Unlawful Internet Gambling Enforcement Act  was attached to the Safe Port Act at the last minute by Representative Bill Frist(R) No one in the Senate had any knowledge of this addition until fifteen minutes before the Act was presented to the floor for debate in a late night session.  There was no time for debate on this late addition to the Port Security Act and no politician in his right mind would vote against Port Security.   &#13;<br />
Most political analysts from across the spectrum agree that this act could never have been passed if it had been presented separately.  While the Safe Port Act is important to the security of the United States, one wonders what this addition has to do with national security.  The bill was passed almost unanimously by both the House and Senate with no time to debate this ill conceived amendment.  &#13;<br />
Under this act participation in online gambling is not banned or criminalized.  Essentially this Act requires banks and other financial institution to adopt policies and procedures that blocks the flow of funds to online gambling sites.  It specifically bans the use of credit cards and checks for online gambling.  &#13;<br />
While this site does not in any way advocate any illegal activity, a quick google search will show many alternatives to credit cards and checks.  Most US based online gamblers consider this act a serious infringement on their privacy and personal liberty. &#13;<br />
 Opposition to this act covers the whole political spectrum.  One conservative website raises some very relevant points.  First, internet technology renders enforcement futile.  The freedom the internet offers handicaps law enforcement and rapid innovation ensures that law enforcement will fall farther and farther behind.  Second, the internet is an instant detour around domestic prohibitions.  National sovereignty prevents the US from forcing other countries from enforcing bans on activities that are legal in those countries.  &#13;<br />
Most importantly consumer demand and the government demands for more revenues will create political pressure for legalization.  And last but certainly not least is the premise that online gambling will bring competition to an industry that has long enjoyed the shelter of highly restrictive licensing practices.  The bottom line is, Americans love to gamble and they cherish their liberties and privacy.  &#13;<br />
Recent studies show that as many as 60% of Americans have gambled and only a tiny minority regards online gambling as immoral.  Americans have overwhelmingly shown they support the online gambling industry.  The billions spent on online gambling prove this point. &#13;<br />
 The arguments against online gambling are weak at best.  Some opponents of online gambling suggest that the internet encourages gambling addictions.  Studies have clearly shown that online gambling is less addictive than drinking (a legal activity) and certainly much less addictive than smoking.  Online gambling does not kill or cause cancer.   A vast majority of online gamblers bet small sums for their own pleasure and from the privacy of their own homes.  Americans, liberal and conservative alike overwhelmingly resent government intrusion into their private lives.  &#13;<br />
Another argument used by prohibitionists is the claim that online gambling is used to launder money and support terrorism.  There has not been one connection made between online gambling and terrorism.  The money laundering argument is irrelevant given the many other ways to launder money.  Weak arguments indeed.  &#13;<br />
There is legislation pending in congress introduced by Barney Frank which would do away with most of the provisions in the Unlawful Internet Gambling Enforcement Act.  This bill has broad bipartisan support.  Hopefully congress will respect the will of the majority of the people that elected them.  I urge all of you who participate in online gambling to contact you representative and senator and let them know how you feel.  Regulation of private matters is a slippery slope that we should not go down.  </p>
